Terms of Service

These terms govern your use of viabandwidth (the “Service”), an infrastructure-intelligence directory and contact-reveal platform operated by Steven Higashi, a sole trader (entrepreneur individuel) registered in France under SIREN 842 245 599, 8 Rue Masson, 69001 Lyon, contactable at [email protected]. By creating an account, buying credits, or otherwise using the Service, you agree to these terms. If you use the Service on behalf of an organisation, you confirm that you are authorised to bind it.

1. Definitions

  • Directory means the searchable database of infrastructure providers we compile and publish.
  • Credit means a prepaid unit you buy and spend to reveal a contact route.
  • Reveal means unlocking an organisation’s business contact route in exchange for one credit.
  • Contact route means a role-based business contact, such as a sales inbox, a sales phone line, and a public website. It is not the personal data of a named individual.
  • Account means the registered profile through which you use the Service.

2. What the Service is

viabandwidth lets you search and filter a directory of infrastructure providers and, for a credit, reveal an organisation’s role-based business contact route. The directory is compiled from public sources and is offered for legitimate business-to-business research and procurement. It is provided for informational purposes and is not investment, legal, procurement, or professional advice.

3. Eligibility and accounts

You are responsible for the accuracy of your registration details, for keeping your credentials secure, and for all activity under your account. You must be at least sixteen years old and not barred from receiving the Service under applicable sanctions or export-control law. We may refuse, suspend, or close an account that we reasonably believe breaches these terms.

4. Credits, fees, and billing

  • Credits are prepaid and are bought in packs. Searching and filtering the directory is free and does not consume credits. A credit is consumed only when you choose to reveal a record.
  • Credits do not expire while your account is open and in good standing, and there is no monthly reset. Credits have no cash value except as set out in the Refund & Cancellation Policy, and they are not transferable.
  • Once a credit has been spent to reveal a record, that reveal is delivered and is final, subject to the Working-Contact Guarantee in the Refund & Cancellation Policy. Revealing the same record again does not cost an additional credit.
  • Prices are shown on our pricing page and are exclusive of any taxes unless stated otherwise. We may change prices for future purchases, but a price change never affects credits you have already bought.
  • Payments are processed by our payment provider, Stripe. We do not see or store your full card details. By buying credits you authorise the charge shown at checkout.

5. Refunds

Our Refund & Cancellation Policy forms part of these terms and explains when you get your money or your credits back. In short: a delivered reveal is final; a contact route that does not work is re-credited under the Working-Contact Guarantee; and unused credits are refundable within thirty days of purchase. Your mandatory statutory rights are unaffected.

6. Acceptable use of revealed contacts

The contact routes the Service reveals are role-based business contacts, provided for legitimate procurement and partnership outreach. Your use of them is governed by our Acceptable Use Policy, which is part of these terms. In particular, you must not resell or redistribute revealed contacts, send unsolicited bulk marketing or spam, ignore an opt-out, or use a contact for employment, credit, insurance, housing, or debt-collection decisions. You are the controller of any personal data you obtain through the Service and are responsible for processing it lawfully. Misuse is a material breach and may result in suspension without refund.

7. No scraping or bulk extraction

The directory and its compilation are protected by intellectual-property and database rights. You may not scrape, crawl, harvest, or bulk-extract the directory by any automated means, circumvent the credit mechanism, reconstruct the underlying dataset, or use the Service to build a competing directory. Access is for interactive use through the provided interface and any official API under its own terms.

8. Accuracy and availability

The directory is compiled from third-party and public sources and is offered on a best-effort basis without warranty of accuracy, completeness, or fitness for a particular purpose. Records may be out of date or incomplete. The Service is provided “as is” and we do not guarantee uninterrupted availability. The Working-Contact Guarantee in the Refund & Cancellation Policy is your remedy for a contact route that does not work.

9. Intellectual property

The Service, its software, design, the directory compilation, and any analytical frameworks or branding are the property of Steven Higashi unless otherwise indicated. You may not use our name, branding, or framework names in a way that implies endorsement or partnership where none exists.

10. Data protection

How we handle personal data is set out in our Privacy Policy. When you obtain a business contact through the Service, you act as the controller for your own processing of it, and we act as an independent controller for the Service itself. Where you need a data-processing agreement or the EU Standard Contractual Clauses for your own compliance, contact us and we will make the relevant terms available.

11. Liability

To the maximum extent permitted by law, Steven Higashi and any contributors are not liable for indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including loss of profits, data, or goodwill, even if advised of the possibility. Where a full disclaimer is not permitted, our total liability for direct damages relating to your use of the Service is limited to the amount you paid for the relevant service in the twelve months before the claim, or one hundred euros, whichever is greater. Nothing here limits liability that cannot be excluded under French law or mandatory consumer-protection rules in your place of residence.

12. Suspension and termination

We may suspend or terminate access for breach of these terms, in particular for misuse of revealed contacts or for scraping. You may close your account at any time. On termination, any valid refund or Working-Contact claim you have already made is still honoured, and the privacy and retention rules in our Privacy Policy then apply.

13. Changes to the Service and these terms

We may update the Service and these terms as the product evolves. The “last updated” date above marks the current version, and we will highlight material changes on the site. Continued use after a change means you accept the updated terms.

14. Governing law and jurisdiction

These terms are governed by the laws of France, without regard to conflict-of-laws principles. Disputes that cannot be resolved through good-faith negotiation will be submitted to the exclusive jurisdiction of the competent French courts, except where mandatory consumer-protection law in your place of residence reserves jurisdiction to your local courts. Nothing here limits rights granted to consumers established in the EEA under Regulation (EU) No 1215/2012, the GDPR, or any successor regulation.
